A New York couple was arrested in Miami after being accused of smoking marijuana inside a closed car with a 2-year-old boy inside.
Phillip Fraisar, 36, and Kasey Renee Buckmann, 27, were arrested on Sunday, Aug. 31, according to court records obtained by PEOPLE. Both were charged with one count of child abuse (no harm).
Buckmann was also charged with possession of marijuana. Fraisar was also charged with one count of felon in possession of a firearm. He was previously convicted in 2015 in New York for criminal possession of a weapon, per Local 10 News.
Around 9:20 p.m., a passerby allegedly discovered they were smoking marijuana and drinking tequila in a parked car with Fraisar’s toddler in the backseat, Local 10 News reports, citing arrest reports. Once authorities arrived at the scene, Fraisar had left the car, but Buckmann and the toddler were still inside.
“The marijuana smoke filled the vehicle, as is commonly referred to as hot-boxing,” the Miami Police Department said, per the outlet.
Once Fraisar returned, authorities alleged they took possession of a pistol in the glove box and a “large clear bag of marijuana” tucked under the driver’s seat, per Local 10 News. The pair was arrested outside the Clevelander Hotel in Miami.

Fraisar was being held on a $1,000 bond and has since been released. Buckmann was also released, per court records.
They are both due in court for their arraignments on Tuesday, Sept. 30, at 9 a.m.
